For the current online sale Patria operates the auction platform and sale process. If Patria acts for a third-party owner on a particular lot, that role is identified in the lot record or durable post-sale confirmation. Registration and verification

Bidding is reserved for persons aged 18 or over using accurate registration details, a confirmed email address and a protected buyer session. Registration alone does not create a purchase contract.

Eligibility may be activated automatically after technical and email checks. Patria may request proportionate identity, source-of-funds, KYC/AML, sanctions or authority documents and may suspend an account where reasonably necessary for legal compliance, security, fraud prevention or auction integrity. The buyer may request human review through support.

Credentials are personal. The account holder is responsible for protecting them and must notify Patria promptly of suspected unauthorized use.

Pre-contractual information

Before the buyer submits a binding bid, the lot page and these conditions provide the operator identity, essential lot characteristics, condition information, starting or next minimum bid, exact buyer-premium percentage, accepted payment method, delivery restrictions, shipping-cost criteria, complaints route and consumer-withdrawal position.

The current auction uses the published starting or next minimum bid and no separate hidden reserve. A buyer who sees missing or contradictory economic information must not bid and should contact Patria for clarification.

Prices are in euro. The bid acknowledgement and payment-obligation button immediately before submission form part of the pre-contract information.

Online bids

A bid is a binding offer by the buyer when the server accepts and records it after the buyer has accepted these conditions. The sale contract is concluded at the lot's closing time with the highest valid bidder recorded by the server, subject only to mandatory law and correction of a documented material error.

The server rejects bids below the displayed minimum or outside the applicable increment. Server time and the accepted-bid audit record control priority; where requests compete, the first valid bid accepted under the locked server state takes priority.

A valid bid accepted during the final five minutes extends that lot's closing time to ten minutes after the accepted bid. The rule may repeat. The updated closing time displayed for the lot is authoritative.

Patria may withdraw a lot or pause the sale before closing for a documented legal, security, ownership or material-catalogue issue. An affected bidder will be informed. Patria will not cancel a valid winning bid merely to seek a higher price.

Lots, condition and provenance

Lot records and their photographs describe the object, dimensions, technique, attribution, condition and known provenance. Screen colour, scale and image presentation can differ from the physical object; additional images or an inspection appointment may be requested before bidding.

Antique, used, unique and collectible lots may show age, wear, restoration, losses or later interventions. Condition and provenance statements are made in good faith on the information reasonably available and are not a waiver of any mandatory legal conformity right.

Attributions, dates and authorship are reasoned catalogue opinions unless an express certificate or guarantee says otherwise. Patria may publish a material correction before closing; the correction becomes part of the lot description and affected bidders are notified where practicable.

Buyer premium and amounts

The buyer premium is the exact percentage shown on the lot page immediately before bidding and is calculated on the hammer price. A displayed rate of 0% means that no buyer premium is charged for that lot.

The amount due is the hammer price plus the displayed buyer premium and any shipping, insurance, customs or export cost expressly accepted after a quote. Patria does not add an undisclosed platform fee.

The applicable VAT or margin-scheme treatment is stated on the invoice. No separate VAT surcharge is added to the bid unless it was clearly disclosed before the bid.

Final bids and mandatory rights

Every server-accepted bid is final and cannot be withdrawn. Patria offers no discretionary cancellation, exchange or return merely because the buyer changes their mind.

This finality policy does not exclude rights that mandatory law does not allow the parties to waive. Because the present sale is conducted online only, a person acting as a consumer may have a statutory 14-day withdrawal right from physical receipt unless a specific legal exception was clearly disclosed before bidding and validly applies.

The consumer may notify withdrawal by an unequivocal statement to support@patria.auction, identifying the buyer, lot, date of purchase and date of receipt. The lot must be returned within 14 days after notice. The consumer bears the direct return cost and is responsible only for diminished value caused by handling beyond what is necessary to inspect the lot.

Patria reimburses the sums legally due, including standard outbound delivery where required, within the statutory period and may withhold reimbursement until the lot is returned or the buyer provides evidence of dispatch. The legal conformity remedy for an incorrectly described or defective lot is separate from withdrawal.

The statutory consumer right does not apply to a buyer acting mainly for business or professional purposes. Mandatory national consumer rights remain unaffected.

Post-sale payment

After the award Patria sends a durable confirmation and bank-transfer instructions to the registered email address. Payment is due within seven calendar days unless the invoice expressly grants a longer period.

Bank details are communicated only through an official Patria channel. The buyer should verify any unexpected bank-detail change by calling +39 334 878 7874. The buyer cannot self-confirm payment; cleared-funds confirmation remains an audited staff procedure.

Ownership passes after full cleared payment. After a written reminder, unjustified non-payment may lead to account suspension, cancellation or resale and recovery of documented losses to the extent permitted by law; consumer protections remain unaffected.

Delivery and documents

Collection is arranged with the Patria team at the address confirmed in writing. Shipping is quoted after the award using destination, dimensions, weight, value, packaging, insurance, customs and export requirements; the buyer approves the quote before dispatch.

For a consumer delivery arranged by Patria, transport risk passes when the consumer or a nominated third party physically receives the lot, except where mandatory law provides otherwise. Different risk terms for a professional buyer must be agreed in writing.

Export restrictions, cultural-property review, customs or licences may affect timing, cost and whether dispatch is lawful. Patria does not promise export permission. The buyer should report transit damage promptly with photographs of the object, packaging and carrier label; this request does not reduce mandatory rights.

Applicable law, complaints and language

Complaints are sent to support@patria.auction with the buyer's name, lot number and supporting evidence. Patria aims to acknowledge a complete complaint within 14 calendar days. Privacy requests go to info@patria.auction; security reports go to support@patria.auction.

The former EU ODR platform is no longer available. Where legally required after an unresolved consumer complaint, Patria will provide information about an appropriate alternative dispute-resolution body and whether it participates in that procedure.

Italian law applies, without depriving a consumer of mandatory protection in the consumer's country of residence. The competent consumer court is determined by mandatory law; for business buyers only, the Court of Florence has exclusive jurisdiction where that agreement is valid.

The version accepted with the bid governs that bid. Patria may update terms prospectively but will not impose a materially adverse change retroactively on an already accepted bid.
